Directions for Application for Access to Archives of the National Treasury Administration
  1. The National Treasury Administration (hereinafter as the NTA) has determined to enact these directions in order to process the applications, as stipulated in Article 17 through Article 21 of the Archives Act, for viewing, hand-copying, or duplicating archives (hereinafter as archives access) of the NTA.
  2. An applicant shall either submit a filled application form or a written explanation with reasons to the NTA for applying the archives access. (The mentioned application form is set out in Appendix 1.)
    The aforementioned application may be submitted to the NTA in person, via post mail, or as an electronic image file sent by e-mail.
  3. An application shall be processed, based on the property of the archives access applied, by a respective unit of the NTA.
    When processing an application for archives access, the respective unit shall first inspect the content of the application, retrieval and access the intended archives accordingly, and draft the replying Notice Letter as well as the Archives Access Reviewing Table for the application (as set out in Appendix 2) based on the substance of the applied archives regarding whether to approve the application and then submit them to the responsible supervisory level of the NTA for a decision.
    The decision of approval or denial of the application shall be made in accordance with the stipulations set in Article 18 of the Archives Act, Article 18 of The Freedom of Government Information Law, Article 46 of the Administrative Procedure Act and any other relevant laws and regulations.
  4. The respective unit shall reply the applicant about the approval or denial of the application with a written Notice Letter (as in Appendix 2) sent via post mail or by email within 30 days beginning on the day of receiving the application. If an applicant has applied for too excessive amount of archives access and the NTA is therefore not able to provide the decision of approval or denial of the application within 30 days, the NTA may review this application and reply to the applicant on a batch-wise basis.
    The respective unit shall notify the applicant to rectify the application within seven days if the application is found not in conformance with the provided procedures, lack of information, or without complete elements required. The applicant shall be notified about the approving results of the rectified application within the timeframe set forth in the preceding paragraph and beginning on the rectification date. The application is subject to be rejected due to either no timely rectification or that rectification is not possible.
  5. An approved application for archives access, in principle, only implies access to duplicates except that application for access to original archives has been approved. Based on the principle of separation, if a part of the archives shall be restricted from public access or provision, that part shall be removed from the access, while access to other parts of the archives shall be provided. Paper archives may be provided for access, without effecting the interpretation of the containing information of the archives, through the following ways:
    1. If parts of the original archives that are detachable shall be restricted from the public access, these parts shall be removed from the original archives, before the access taking place.
    2. If parts of the original archives, which are not detachable, shall be restricted from the public access, then these parts shall be concealed appropriately, before the access through photocopy or scanning taking place.
    The respective unit shall put a remark describing what parts of the original archives have being removed or concealed in the Signing Receipt of Archives Access (as set out in Appendix 3) to inform the applicant.
  6. An applicant who reaches the NTA to implement the archives access may only be allowed to enter the premises designated for archives access after showing the Notice Letter of approval and an eligible photo ID as well as having duly completed the registration procedure and being accompanied by a staff of the respective unit.
  7. An applicant shall sign her/his name on the Signing Receipt of Archives Access right after receiving archives for access provided by the respective unit.
  8. An applicant may have archives access only at the premises designated for that purpose; shall hand over the archives and the borrowed stationary to the accompanying staff during her/his necessary but temporary leave without bringing them outside the designated premises; and shall also have finished logging out the NTA’s computer, which the applicant has used to search for the archives catalog, before leaving the premises.
  9. An applicant shall return the archives on the same day after that applicant has access to the archives. If an applicant needs to have more access to the archives that applicant shall return the archives and make an application for the access on another day.
  10. An applicant who has access to the archives applied for shall keep the archives fully intact, and shall not engage in any of the following behaviors:
    1. Annotating, altering, changing, removing, marking, or soiling the archives;
    2. Pulling bound archives apart; or
    3. Damaging or altering the archives in some other way.
  11. When entering the designated premises for archives access, an applicant shall observe the following requirements:
    1. Drinking, eating, smoking, chewing a betel nut or assuming any boisterous activity are all prohibited.
    2. Damaging or soiling the premises are prohibited.
    3. Ballpoint pens, writing brushes, or other instruments that could easily alter or damage the archives are prohibited from bringing into the premises.
    4. Hand-copying of the archives may be fulfilled only with a pencil, a portable computer, or a portable medium.
    5. Connecting to a power source or logging on to the NTA network is not allowed without a prior permission.
    6. Equipment provided by the NTA shall be properly protected, and shall not be damaged.
    Permission is required for the use of "a portable computer or a portable medium" as referred to in preceding paragraph 4; and an applicant using such equipment shall abide by the NTA's information security policy relevant regulations; the portable medium shall be scanned by the NTA for viruses before use.
  12. The NTA may cease any further archives access and make the case a record if the applicant is found having violated any of the provisions of Articles 10 and 11. Any serious violation is subject to relevant laws.
  13. An applicant shall make a returning remark on the Signing Receipt of Archives Access after the returned archives have been well checked for veracity and completeness by the respective unit. A copy of the signed Signing Receipt of Archives Access shall be fabricated and handed to the applicant. The respective unit shall archive the archives along with the signed Signing Receipt of Archives.
  14. The NTA’s designated premises for archives access are open Monday to Friday, except national holidays, from 9:00 a.m. to 12:00 p.m. and from 2:00 p.m. to 5:00 p.m.
  15. Except official use, the archives access is subject to fee stipulations as follows:
    1. For a general archives access, the “Fee Standards for Viewing, Hand-copying or Duplication of Archives” of the National Archives Administration, National Development Council (as set out in Appendix 4), shall apply.
    2. Photographing or filming the archives with citizens’ owned equipment as a mobile phone, a camera, or a video camera shall be permitted by the NTA and is subject to the above fee standards.
    3. The respective shall collect beforehand the postage, processing fees, and duplication fee from the applicant and then send the duplication as well as the receipt to the applicant if that applicant requests the archives duplication be sent by post mail.
    The NTA shall issue receipts to applicants.
